The BC Prosecution Service says no charges will be laid against a Westshore RCMP officer who tried to stop a pick up truck for a motor vehicle infraction seconds before it crashed into a police cruiser in a Langford intersection, killing Cnst. Sarah Beckett last year.
The incident was investigated by the Independent Investigations Office which focused on the actions of the officer who attempted to stop Kenneth Jacob Fenton's truck immediately prior to the collision.
Where the IIO determines an officer may have committed an offence, a report is submitted to the BC Prosecution Service for consideration of charges.
In this case they concluded available evidence does not meet the standard for approval of charges against the police officer.
No reasons for the decision will be released until after proceedings against Fenton has concluded.
It was within seconds of the officer's attempt to stop Fenton's truck for a motor vehicle infraction that the 29 year old ran a red light and broadsided the Beckett's cruiser. He has since pleaded guilty to impaired driving causing death and dangerous driving causing the death.
Fenton's sentencing hearing continues this Friday in Western Communities provincial court.
