The BC Supreme Court has upheld a decision by Victoria City Council turning down a rezoning application for the Green Dragon Medicinal Society at 541 Herald Street.
In a news release city hall says the result confirms Council followed appropriate procedure when it concluded a storefront cannabis retailer was not an appropriate land use in the location, close to where numbers of children and young people can be found.
The court also approved the City's request for an injunction -- meaning the Green Dragon must cease operation.
It's the first injunction granted to the City ordering the closure of an unauthorized cannabis retailer in Victoria.
A Facebook posting by the businesss indicates that they "are closed for good". Bylaw officers checked the premises Monday morning and confirmed retailer has closed.
Meantime the City is actively proceeding withcourt actions against other unauthorized cannabis retailers.
