A judge has dismissed all charges against a Port Alberni man in a Denver sex assault case.
Colby Messer was charged with six counts of sexual assault in April in relation to an alleged incident that took place in a Denver hotel room when he visiting with friends to attend a football game.
Four other charges were dropped in August after a preliminary hearing.
The two of remaining charges have now been dismissed after The Denver District's Attorney's Office says new information found those charges could no longer be proven.
The woman said in a sworn affidavit that she didn't remember getting to the hotel but remembered being sexually assaulted in the room.
Three other Vancouver Island men were described as suspects in the case, but charges were not laid against them.
