BC Ferry and Marine Workers Union will plead a case regarding strike action to the BC Supreme Court this week.
They are fighting for the right to strike, and if the outcome is in the Union's favour, it could significantly impact their ability to bargain with the BC Ferry Corporation.
President of BC Ferry & Marine Workers Union, Graeme Johnston, says they are taking action to provide the right for the workers.
"The BC Ferry and Marine Workers Union is currently unable to take job action, and that comes from a decision that was made by an arbitrator and was also made by the Labour Relations Board. And that's directly contrary to a law that's been set out by the Supreme Court of Canada, so we're going to the Supreme Court of BC to get that overturned."
He adds the ferries are an essential service, and any strike action that may occur would only affect non-essential services that generate additional income for BC Ferries."
"If it's a matter of getting your Grandmother to the hospital for an appointment, or you've just got a meeting or business to take care of, ferry workers want to make sure that that happens, you just might not be able to get a burger on the route."
Johnston adds the right to strike is considered a human right under the Charter of Rights and Freedoms, because it is so essential to the bargaining process.
