Marney Mutch has filed a wrongful death lawsuit against VicPD and the city of Victoria, 2 years after her son was shot by police. Mutch tells CTV Vancouver Island she feels the officers were negligent and in violation of the use of force law. "As far as I'm concerned the actions of the police on that day were both reckless and negligent and there was absolutely no reason that my son should have been confronted by them, by six officers fully armed and terrorizing him, there's no reason that should have happened."
Rhett Much was 20 years old when he was killed inside his Mother's home on Dallas road. Marney Mutch is seeking damages but says her main goal is to shine a spotlight on the actions of the officers involved. Seven unnamed officers are listed in the suit, which seeks a range of damages and argues police were negligent, and used excessive force.
Rhett Much was shot in the neck after his mother called 911 because he had broken into her home after being asked to stay away. He was upset and threatened himself with a steak knife.
The officer who shot her son has been cleared of any wrong doing.
VicPD say officer training is constantly being updated and improved as a result of incidents like this one.
